Terms of Service
These Terms of Service constitute a public-offer agreement (договір публічної оферти) between you and Coachero. By creating an account or otherwise using the Service, you accept these Terms in full. If you do not agree, do not use Coachero.
1. Definitions and acceptance
For the purposes of these Terms:
- “Service” means the Coachero web, mobile, and Telegram-bot applications, available at coachero.app and related domains.
- “Operator”, “we”, or “us” means Individual Entrepreneur (ФОП) Zhura Serhii Serhiiovych, Ukrainian taxpayer number (РНОКПП) 3636304790, registered in Ukraine.
- “Trainer”, “you”, or “User” means the personal trainer or coaching business that registers an account.
- “Student” means an individual the Trainer adds to the platform to receive coaching services.
- “Subscription” means a paid plan (Pro) granting access to features beyond the Free tier.
By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and accept these Terms and our Privacy Policy.
2. The service we provide
Coachero is software that helps personal trainers manage their coaching business: schedule bookings, design and version training programs, track student progress, communicate via Telegram and SMS, and use AI-assisted tools (Spark AI) to draft programs and summaries.
We provide the platform; you provide the coaching expertise. The Service is provided “as is” and is intended for use by qualified personal trainers operating in compliance with applicable Ukrainian regulations.
3. Account creation and authentication
Accounts are created using a Ukrainian mobile phone number, verified via a one-time SMS code; there is no password to set for your account.
You are responsible for the security of the phone number associated with your account and for all activity carried out from your account. Notify us immediately at support@coachero.app if you suspect unauthorised use.
4. Subscriptions, prices, payment, and referrals
Coachero offers two tiers:
- Free — permanent, with limits on the number of students and AI generations.
- Pro — ₴499 per month, with the full feature set for an individual trainer.
You may pay for a Subscription in any of the following ways:
- on the web — by card in Ukrainian hryvnia (UAH) via Monobank acquiring: ₴499 per month, or the annual plan at ₴4990 per year (12 months for the price of 10);
- in the iOS mobile app — via App Store in-app purchase;
- in the Android mobile app — via Google Play in-app purchase.
Auto-renewal (card payment on the web). If you pay for a Subscription by card on the web and opt into auto-renewal, Monobank tokenizes your card and we store an opaque payment token and a masked card number so we can automatically charge the next period’s price (₴499 monthly or ₴4990 yearly) shortly before your current paid period ends, at the same tier and cadence. You can turn auto-renewal off at any time by cancelling your Subscription in Settings → Billing — the saved card is then no longer charged and your Pro access continues to the end of the period already paid for. If an automatic charge fails, we retry during a short grace period; if payment is still not received, the account reverts to the Free tier.
For purchases made through the App Store or Google Play, the respective store bills you directly; in-app prices may be displayed in the store’s currency (the App Store shows prices in US dollars for Ukraine). Auto-renewal of a subscription purchased through a store is managed by that store: you can cancel it in the App Store or Google Play subscription settings. Refunds for store purchases are governed by Apple’s and Google’s policies and are handled by the respective store.
Prices may change with at least 30 days’ notice. Existing subscribers keep the prior price for their next two billing cycles after a price change.
Referral program. You receive a unique referral link. When a trainer you invite subscribes to Pro and pays their first invoice, we credit your account with one free Pro month, applied against your next Pro invoice. The trainer you invite receives no separate discount — their benefit is the standard free first month available to all new accounts. Referral rewards are capped (currently 12 free months per rolling 12 months), are non-transferable, and have no cash value. We may withhold or reverse rewards where we detect abuse or self-referral, and we may change or end the program at any time.
5. Free tier and custom booking links
New accounts start on the permanent Free tier. A new trainer may claim one free first month of Pro (no card required); once claimed it unlocks the full Pro feature set for 30 days, after which Pro continues only if you pay — otherwise the account reverts to the Free tier. Aside from this one-time free month, paid tiers take effect only after payment.
Pro subscribers may claim a personal booking link (for example, coachero.app/your-name). Names are allocated first-come-first-served and remain reserved for the claiming account even if the subscription lapses, although the link resolves only while a Pro subscription is active. We may reclaim or disable a name that infringes third-party rights, impersonates another person or brand, is misleading or offensive, or conflicts with Service routes.
6. Cancellation and refunds
You may cancel your Subscription any time from Settings → Billing. Cancellation stops auto-renewal — the saved card is no longer charged — and takes effect at the end of the current billing period; you keep Pro features until then.
If your Subscription was purchased through the App Store or Google Play, cancellation is done in the subscription settings of the respective store, and refunds for such purchases are governed by Apple’s and Google’s policies and handled by the store, not by us.
We do not provide pro-rata refunds for unused portions of a billing period. We may make exceptions for service outages, billing errors, or force-majeure events at our discretion.
7. Acceptable use
You agree not to use Coachero for:
- spam, harassment, or abusive contact with students or third parties;
- distribution of malware or attempts to compromise the Service or other users;
- illegal content or content infringing third-party rights;
- any activity that violates Ukrainian law or the law of your jurisdiction.
We may suspend or terminate accounts that breach this clause without refund.
8. Your content and your students’ data
You retain all rights to the content you create in Coachero (programs, notes, photos, messages). By using the Service you grant us a non-exclusive licence to host, process, and display that content solely as needed to provide the Service to you.
You are responsible for obtaining your students’ informed consent before adding their personal data (name, phone, photos, measurements, training history) to the platform. In relation to your students, you act as the data controller; we act as a data processor on your behalf. See the Privacy Policy for details.
9. AI-generated content
Spark AI uses Google (Gemini) and OpenAI models to draft programs, summaries, and replies based on the context you provide; the models are reached through the OpenRouter router, or directly through Google (Gemini) when it is unavailable. These services act as data processors: the context is sent to them to generate a response, is not used to train their models (per the respective API terms), and we sanitize inputs against prompt injection. AI output is a suggestion, not professional advice. You are solely responsible for reviewing and approving AI-generated content before applying it to a student’s training plan. We do not warrant the accuracy, completeness, or fitness-for-purpose of AI output.
10. Liability and service availability
Coachero is a software tool. We are not a fitness, medical, or nutritional advisor. Any training programs, exercises, or assessments produced through the Service reflect the professional judgement of the Trainer using the platform. We are not liable for any injury, illness, or other adverse outcome arising from training conducted with Coachero. Trainers are responsible for ensuring their professional practice complies with applicable Ukrainian regulations.
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance is announced in advance where possible. We are not liable for losses caused by downtime, third-party service failures (e.g. Monobank, Apple, Google, Telegram, Cloudflare, Hetzner), or events outside our reasonable control.
11. Intellectual property
Coachero, the Coachero brand, the source code, the user interface, and all related design and documentation are the property of the Operator. Nothing in these Terms transfers ownership of our intellectual property to you.
12. Termination, changes, governing law
Termination by you. You may terminate your account any time from the account menu in the app (Delete account), or by emailing support@coachero.app.
Termination by us. We may terminate or suspend accounts for material breach of these Terms, with reasonable notice except in cases of illegal activity, fraud, or abuse.
Changes to these Terms. We may update these Terms from time to time. For material changes affecting paid subscribers, we will email account holders at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Governing law and disputes. These Terms are governed by the laws of Ukraine. Disputes that cannot be resolved by direct contact (support@coachero.app) shall be submitted to the competent Ukrainian courts at the registered address of the Operator.
